Please read these Terms of Service (“Terms”) carefully before using Styrar(the “Service”). We are Styrar (“we”, “our”, or “us”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By agreeing to these Terms, you represent that you are at least 16 years of age. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and current registration information.
• Notify us immediately at [email protected] if you suspect unauthorised access to your account.
• Not share your account credentials with others outside your workspace.
• Enable two-factor authentication for accounts with elevated permissions.

We reserve the right to suspend or terminate accounts that show signs of unauthorised access or that violate these Terms.

3. Acceptable use

You agree not to use the Service to:

• Post, schedule, or distribute content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
• Violate the terms of service of any connected social media platform.
• Send spam, unsolicited messages, or engage in any deceptive marketing practice.
• Scrape, crawl, or otherwise extract data from the Service beyond normal use.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Interfere with, disrupt, or harm the Service or its servers.
• Distribute malware, viruses, or other harmful code.
• Impersonate another person or entity.
• Violate any applicable law or regulation, including data protection and privacy laws.

4. Your content

You retain ownership of all content you create, upload, or publish using the Service (“User Content”). By using the Service, you grant Styrar a limited, non-exclusive, worldwide licence to store, process, and display your User Content solely as necessary to provide the Service to you.

You represent and warrant that you have all rights necessary to grant this licence and that your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.

We do not use your User Content to train machine learning or AI models, and we do not sell your content to third parties.

5. Third-party integrations

The Service connects to third-party platforms (including social media platforms and Shopify). Your use of those platforms is governed by their own terms of service and privacy policies. We are not responsible for the actions or content policies of third-party platforms.

When you connect a Shopify store, you authorise us to access your store data - including product information and status - to the extent permitted by the Shopify API access scopes you grant. You remain responsible for complying with Shopify's Partner Program Agreement and any applicable Shopify policies.

6. Intellectual property

The Service, including its design, source code, logos, and all content we create, is owned by Styrar and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying technology without our written permission.

The Styrar name and logo are trademarks of Styrar. Nothing in these Terms grants you any licence to use our trademarks.

7. Payment and billing

Paid plans are billed in advance on a monthly or annual basis. All prices are shown in USD unless otherwise stated. Taxes may apply depending on your location and will be added at checkout where required by law.

Payments are processed by Stripe. By providing payment information you authorise us to charge the applicable fees to your payment method.

You may cancel your subscription at any time from your billing settings. Cancellation takes effect at the end of the current billing period; no refunds are issued for partial billing periods unless required by applicable law. If your payment fails, we will notify you and may suspend your account until payment is resolved.

8. Free tier and trials

We offer a free tier with limited features. Paid plan free trials last 14 days. You must add a payment method when you start a paid trial; you will not be charged until the trial ends. We email you a few days before billing starts. If you cancel before the trial ends, your workspace reverts to the free tier (or is limited accordingly) when the trial ends.

9. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms or for any other reason at our discretion. Upon termination:

• Your right to use the Service ceases immediately.
• We will delete your data in accordance with our Privacy Policy.
• Provisions of these Terms that by their nature should survive termination will do so.

10. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of liability

To the maximum extent permitted by applicable law, Styrar and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising from or related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) €100 (or local currency equivalent).

12. Indemnification

You agree to indemnify and hold harmless Styrar and its officers, employees, and agents from and against any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

14. Modifications to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or in-app notice at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes your acceptance of the revised Terms.

15. Governing law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of the Netherlands, unless otherwise required by mandatory consumer protection laws in your jurisdiction.
